Mahamaya Shiksha Parishad Paschim Banga is a legally established autonomous body which is conducting education programmes for disadvantaged, street children, women and poor people and development of education under the guidelines of national education policy 1986 Govt. of India and programme of action 1992 Govt. of India Guidance of jurists, eminent educationists and social workers for the development of education in wide areas.

Mahamaya Shiksha Parishad Paschim Banga is registered under Government of NCT of Delhi, the Shiksha Parishad for propagation and development of distance education on the pattern of Non-Formal, Regular, Private, Open continuing, Distance Education System to offer specialized services to the government and other agencies in the field of education, in general, and school education, in particular, for the development and growth of distance and open school system and develop proper curriculum for vocational and enduring education to prepare student population for the world of work. Mahamaya Shiksha Parishad Paschim Banga is registered under the Trade Mark Registration No: TM 4504913 and CR MHRD, Government of India Registration No: 11710/2020-CO/L.

To as certain linkages with traditional education systems like State Open Schools, Sanskrit Boards and Madarsas, Shiksha Parishad with predictable education system with mobility across them and equivalence between them, the MSPPB wishes to work in close association with the Open Schools, State Open Schools, Sanskrit Boards and Madarsas, Shiksha Parishad In this regard, MSPPB will also follow the norms for conducting examinations as also follow National Curriculum Framework, 2005, as amended from time to time.

Mahamaya Shiksha Parishad Paschim Banga was envisaged as a comprehensive instructional release institution that offered the autonomy to students to get education without the bottleneck of attending daily classes. We have succeeded in creating a distance education program as a planned extended learning endeavor. MSPPB has gained an expertise in delivering instructional possessions and thereby providing opportunities to students located away from the organization.

We have expanded our distance education program in India. With comprehensive online solutions for the students; our axiom is to help everyone in need of quality education in all corners of the world. The remarkable contribution of MSPPB in the field of education has been to achieve Discipline and quality of education which is the backbone of MSPPB.

The Nationality policy on Education suggested intensification of MSPPB for extending open learning facilities in a phased manner at High School & Intermediate levels all over the country and abroad as an independent system with its own curriculum and examination leading to awarding of certificates.

AIM, ACTS AND RIGHTS OF MAHAMAYA SHIKSHA PARISHAD PASCHIM BANGA

The Shiksha Parishad, under Government of India, is a Legal Autonomous and non-profit Institution and has legal right of teaching & training under the provision of constitution. Copies of Bylaws, prospectus, etc. are sent to the various Authorities and Departments of the Government of India, State Governments and Union Territories by the Shiksha Parishad from time to time. The area of operation of the Shiksha Parishad will be within the territorial borders of whole of India. Information centres of examination are situated in almost all-major cities of India where semester/annual examinations are normally organized. Mahamaya Shiksha Parishad Paschim Banga fulfils the aims of educational right of India constitution 1950 under Article14, 15, 19(1), 21, 26, 29,30,45,46 & 351.

LEGAL STATUS OF MAHAMAYA SHIKSHA PARISHAD PASCHIM BANGA

Mahamaya Shiksha Parishad Paschim Banga with the help of educational experts, will educate un educated boys, girls, men and women for upliftment of the literacy in India. So that they can serve society effectively and with dignity. Mahamaya Shiksha Parishad Paschim Banga will impart education with international techniques and with stress on morally, mentally, physically and socially personality. Ours is an autonomous body and all private educational Boards / Councils are autonomous bodies. Each educational organization is having discretionary powers. According these powers, every board /University / state Govts. / Central Govt. of India is having the liberty and right to take own decision either to allow or refuse any admission / service. But we strive to give our best to make the non-formal education programme grand success. All the education programmes conducted by Mahamaya Shiksha Parishad Paschim Banga are autonomous education programmes. Legality, Validity, Utility of the education programmes of Mahamaya Shiksha Parishad Paschim Banga is in strict conformity with the constitution of India and law of the land under Article 19(1) G, 29 & 30.

JUDGMENT OF HON’BLE SUPREME COURT

The Shiksha Parishad trustees/members has the constitutional right under Article 19 (1) (g) to pursue any profession or any occupation and administering teaching institutes have been included as part of occupation as held by Hon'ble Supreme Court in T.M.A. Pai Foundation Vs. State of Karnataka (SC) 2003 (2) SCT 385. The relevant portion of the above said judgment is reproduced as under:-Private education is one of the most dynamic and fastest growing segments of post-secondary education at the turn of the twenty –first century. A combination of unprecedented demand for access to higher education and the inability or unwillingness of government to provide the necessary support has brought private higher education to the forefront. Private institutions with a long history in many countries, are expanding in scope and number, and are becoming increasingly important in parts of the world that relied almost entirely on the public sector.

FUNDAMENTAL RIGHT AND REASONABLE RESTRICTION UNDER CONSTITUTION OF INDIA

The only reasonable restriction on the exercise of this right can be imposed Under Article 19 (1) (g) and is imposed in clause 19 (6). The only restrictions that State can make the law imposing reasonable restriction in the interest of general public or any restriction regarding profession and technical qualification necessary for practicing any profession or occupation, trade or business. Since so far no such professional or technical qualification have been notified, therefore, the trustees/members of the Parishad through their Society have a fundamental right to carry on the profession /occupation of running the Institutes which imparts education. Private boards are not illegal: Says Court (From Hindustan Newspaper 09-09-2004) HON’BLE SUPREME COURT ORDER IN THE FAVOUR OF PRIVATE BOARDS, Dated 12-07-2013, Hon’ble Supreme Court of India gives order in the favour of A Private Board about the admissions of pass out candidates.
